This presentation will consider the recent Federal Court decision in Republic of Peru (Peruvian State) v Registrar of Trade Marks [2026] FCA 791 concerning Peru's application to register PISCO as a certification trade mark. This is the first substantive decision by the Federal Court on certification trade marks, and illustrates how geographical indications – especially a contested one like PISCO – is protected under the certification trade mark system in Australia.

Andrew Fox SC principally practises in intellectual property and commercial litigation, including trade practices. Andrew’s intellectual property experience spans the full spectrum in that field, including patents, trade marks, copyright, designs, confidential information and consumer protection. He has appeared in a number of leading cases (including in the High Court) and appears regularly in the Federal Court of Australia and in patent and trade mark oppositions held at IP Australia.

Andrew’s patent experience traverses a wide range of technology fields, including mining, mechanical, chemical, pharmaceutical and telecommunications. He also has considerable experience in general commercial litigation, having appeared in proceedings before the Supreme Court of NSW, the District Court of NSW and in interstate Courts.

Andrew is recognised in Chambers and Partners Asia Pacific as a leading Senior Counsel in intellectual property (2026 – Band 2); Doyle’s Guide to Australian Leading Lawyers (2026); Best Lawyers in Australia; The World’s Leading Trademark Professionals; The Legal 500 – Australian Bar – Intellectual Property. Andrew is also admitted to practice as a Barrister in New Zealand.

Angela McDonald practises in all aspects of Intellectual Property including patents, trade marks, copyright, designs and consumer protection. Angela has been featured in Doyle’s Intellectual Property list since 2021.

Angela regularly appears in the Federal Court of Australia, including the Full Court, various state Supreme Courts, the Patent Office and the Trade Mark Office.

Prior to coming to bar, Angela was a solicitor in two specialist IP firms. Angela was also the Associate to Justice Nicholas of the Federal Court of Australia where she gained extensive experience in intellectual property disputes and large commercial matters.

Angela graduated with first class honours in law from the University of New South Wales. Angela is also on the Editorial Panel for the Australian Intellectual Property Law Bulletin, is a co-author of the LexisNexis Australia Copyright & Designs chapter on International Copyright and has also authored a number of publications in intellectual property law.
