Issues raised by the Full Court in Encompass: Are the approaches, which are said not to be matters of guiding principle, capable of providing a coherent basis for analysis?
Speaker:
David Shavin QC: David has been a member of the Bar for over 41 years having taken silk in 1993. David practises in both Australia and New Zealand, primarily in the fields of intellectual property – predominantly patents and trade marks, competition, telecommunications and commercial law. He is, and has been for over 35 years, a member of each of the Trade Practices Committee and the Intellectual Property Committee of the Business Section of the Law Council of Australia and, for over 20 years, a member of the Practice and Procedure Liaison Committee between the Federal Litigation Section of the Law Council and the Federal Court of Australia. He is also a member of the Liaison Committee between the Law Council and the Federal Circuit Court.
David has appeared in a number of the recent manner of manufacture cases including for Myriad in both the Federal Court and the High Court ; for Encompass at first instance and on appeal; for Rokt at first instance and will appear in the appeal in February; in Aristocrat which is part heard, and with Helen Rofe QC in Sequenom.
